POSITION SUMMARY


The position provides counsel to Kaiser Permanente
regarding traditional labor & employment laws. This is an opportunity to
have a challenging and rewarding labor & employment law practice in a
complex business and labor environment, supporting Kaiser Permanente-s
operations as a non-profit integrated delivery system, including Kaiser
Foundation Health Plan, Kaiser Foundation Hospitals, and aspects of the
Permanente Medical Groups in California and the eight other jurisdictions where
Kaiser Permanente operates.





PRINCIPAL RESPONSIBILITIES


  • Counsel and represent clients on
    complex labor and employment law issues, including just cause discipline and
    discharge in union and non-union environments, EEO, reasonable accommodation, wage
    & hour, leave of absence, retaliation and whistleblower, traditional labor
    relations, and other labor and employment law matters.

  • Provide strategic advice on a wide
    variety of labor and employment legal issues and projects.

  • Handle cross-disciplinary legal
    matters in collaboration with regulatory and business attorneys and other
    professionals and paraprofessionals.

  • Engage with outside counsel to
    efficiently deliver legal expertise to KP when needed.

  • Evaluate and communicate legal
    risks associated with complaints, grievances, charges, employer practices, and
    other legal matters.

  • Litigate matters before federal and
    state agencies, including the NLRB, EEOC, and DOL.













WORKING
RELATIONSHIPS


The position works closely with the VP &
Assistant General Counsel, Labor & Employment and members of the Labor
& Employment Group, Human Resources and Labor Relations leaders and
consultants, leaders and members of other Legal Department Practice Groups, and
Hospital and Health Plan Senior Leadership. The position will represent Kaiser
Permanente in dispute matters with State and Federal regulators, arbitrators,
and opposing counsel and will manage outside counsel relationships as assigned
for given legal matters pertaining to Labor & Employment.









ESSENTIAL FUNCTIONS


  • Under the supervision of more senior attorneys, provides legal counsel
    to middle management, senior management and executives on complex and legal
    issues which have a significant impact to the organization.

  • May counsel leaders and management whenever legally unsound
    decisions or plans are being made or when changes in the law occur.

  • Handles multiple legal matters in collaboration with other
    attorneys and paraprofessionals. May provide work review to paraprofessionals.

  • Under oversight of practice group management, engages with outside
    counsel to efficiently deliver legal expertise to KP when needed.

  • Prepares legal documents, memoranda and other forms of
    communication regarding transactional or legal advice.














 

 

Basic Qualifications:


  • Minimum seven (7) years of experience as an attorney in a law firm or company or in government in one or more legal specialties.

  • A juris doctorate degree, required.

  • Membership in local bar association.

     

    Additional Requirements:

  • Experience and knowledge advising and representing clients on employment law matters, including wage and hour, discrimination, retaliation, and leave laws and representing clients before agencies enforcing those laws. Experience and knowledge advising and representing clients in unionized workplaces.

  • Experience in the health care industry.

  • Experience advising complex organizations with interaction between multiple legal entities.

  • Experience advising/representing clients:

    • In union environments.

    • On the California Equal Pay Act.

    • On affirmative action program compliance

    • On wage & hour matters

    • On traditional labor matters

  • Demonstrates skillful insight into critical business problems and emerging legal issues.

  • Proven ability to render timely and sound legal advice within applicable legal principles.

  • Maintain current knowledge of labor and employment law. 

  • Must have excellent written and oral advocacy skills and strong interpersonal skills
